Food-Upwaw Terms of Use

These Terms of Use govern your use of the Food-Upwaw website and, unless otherwise specified, your use of any other website or mobile application owned or operated by Food-Upwaw Bulgaria or operated on behalf of Food-Upwaw (collectively, the “Websites”). Please read these Terms of Use carefully before using the Websites.

Agree to the terms

By using the Websites, you agree to these Terms of Use and Food-Upwaw's General Online Privacy Policy (for visitors who are eighteen (18) years of age or older) or Food-Upwaw's Kids Online Privacy Policy (for visitors under eighteen (18) years of age) which are included here by reference. Each time you use the Websites, you reaffirm your acceptance of the then-current Terms of Use. If you do not wish to be bound by these Terms of Use, your sole remedy is to stop using the Websites.

Food-Upwaw may change these Terms of Use at any time and in its sole discretion. Revised Terms of Use are effective immediately upon posting and you agree to the new posted Terms of Use by continuing your use of the Websites. You are responsible for staying informed of any changes. If you do not agree to the revised Terms of Use, your sole remedy is to stop using the Websites.

You may be required to create an account and select a password to use certain features of the Websites. You agree to provide true, accurate, current and complete information about yourself and to maintain and update it as prompted by the registration processes. You may not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity, including by using another person's username, password, or other account information.

You are entirely responsible for maintaining the confidentiality of your password and account. You are fully responsible for all activities undertaken by you or anyone using your account. You agree to protect your password from access by others. If you believe your account has been hacked, you should contact us immediately by mail at: [email protected] or send a message to our live chat service. You agree to indemnify and hold Food-Upwaw harmless from losses suffered by Food-Upwaw or another party due to someone else using your account as a result of your failure to use reasonable care to protect your password.

Cancellation

You have the right to cancel your order up to five minutes after placing your order on the Food-Upwaw platform. After this point, the restaurant will start preparing the food and therefore no refund will be possible. For the avoidance of doubt, timing will be assessed based on the point at which you place your call with our call center, or send a message to our live chat service. In the event that cash on delivery is required, your order will be delivered as instructed and the cash must be collected by the passenger. In the event that a customer refuses to pay cash to our passenger, Food-Upwaw reserves the right to limit its future cash payments.

Content posted by other users

Food-Upwaw is not responsible for and does not endorse any content in any post made by other users on the websites. Under no circumstances will Food-Upwaw be liable, directly or indirectly, for any loss or damage caused or alleged to have occurred to you in connection with any content posted by a third party on the Websites. If you become aware of abuse of the Websites by anyone, please contact Food-Upwaw via email: [email protected] or send a message to our live chat service.

If you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately.

Activities prohibited on websites

The following is a partial list of the types of illegal or prohibited conduct on the Websites. Food-Upwaw reserves the right to investigate and take appropriate legal action against anyone who, in Food-Upwaw's sole discretion, engages in any of the prohibited activities. Prohibited activities include, but are not limited to, the following:

- use the Websites for any purpose that violates local, state or federal laws or regulations;

Post content that infringes the intellectual property rights, privacy rights, publicity rights, trade secret rights, or any other rights of any party;

- Post content that is unlawful, obscene, defamatory, threatening, harassing, abusive, defamatory, hateful, or embarrassing to any other person or entity as determined by Food-Upwaw in its sole discretion or in accordance with Local Community Standards;

- post content that constitutes cyberbullying, as determined by Food-Upwaw in its sole discretion;

Post content that depicts any dangerous, life-threatening, or risky behavior;

Post phone numbers, street addresses, or last names of anyone;

- Posting URLs on external websites or any form of HTML or programming code;

Post anything that may be "spam" as appropriate
